To make it truly efficient and equitable, auction time-limited permits periodically and give the proceeds to the people. The number of permits should match what a random survey of citizens indicates is the amount that most people would say is about right. This feature that has public policy made to follow what the average opinion calls for is a way to make the philosophical assertion that the air and water belong to all? of us embodied materially in the functioning of the economy and society.

If we followed the US Constitution, "equal protection" would mean something. But the unelected? fourth branch of government -- the immense, unaccountable federal bureaucracies -- like the EPA, doesn't give a damn what you, congress, nor I think -- what's fair -- or whether the Constitution authorizes its existence. Which is something to think about long and hard in 2012. It's all about money. You want the EPA deciding where America's money goes? EPA fees/fines are taxation without representation.
